The day January 14, 2021, With 97 votes in favor, 13 abstentions and 1 vote against, the Chamber of Deputies approved the draft agreement approving the Protocol Relating to the Madrid Agreement Concerning the International Registration of Trademarks.

With this initiative, the government seeks to insert Chile in a modern Intellectual Property (IP) ecosystem, which will simplify procedures, reduce costs and formalities derived from the protection of a trademark abroad.

Once the law is passed and enacted, it will allow applications for trademark registrations to be filed in more than 100 countries that are already part of the Madrid Protocol, in an economical and simple way.

It is important to point out that the Madrid Protocol is not a trademark granting system, nor does it replace national registrations, since international applications must comply with the requirements of the Industrial Property Law of each country.

As the bill progresses through the Senate, we will report on its scope, implementation and implications in Chile and abroad.
